Acceptance of Terms
By accessing or using Polana ("the Platform," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
These Terms constitute a legally binding agreement between you (the "User") and Polana. Your continued use of the Platform constitutes ongoing acceptance of these Terms.
Medical Disclaimer
Not a Substitute for Professional Care
POLANA IS NOT A MEDICAL SERVICE OR PROFESSIONAL MENTAL HEALTH PROVIDER.
- The Platform provides self-assessment tools based on validated screening instruments (PHQ-9, GAD-7, etc.).
- Assessment results are for informational and educational purposes only.
- Results do not constitute a clinical diagnosis and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
- Always seek the advice of a qualified mental health professional or physician with any questions regarding your mental health or medical condition.
- In case of emergency or thoughts of self-harm: Call emergency services (112 in EU, 988 in US, 116 123 Poland crisis helpline) or visit your nearest emergency room immediately.
Eligibility and Account Registration
Age Requirement
You must be at least 18 years old to use the Platform. By creating an account, you represent and warrant that you are 18 years of age or older.
Account Responsibilities
- You are responsible for maintaining the confidentiality of your password and account credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access or security breach at security@polana.app.
- You may not share your account with others or create multiple accounts.
Permitted Use of the Platform
You may use the Platform to:
- Complete validated mental health self-assessments
- View your assessment history and progress over time
- Generate reports and analytics based on your data
- Export your data for personal use or sharing with healthcare providers
- Access mental health resources and educational content
Prohibited Use
You agree NOT to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Use automated systems (bots, scrapers) to access the Platform without permission
- Upload malicious code, viruses, or attempt to disrupt Platform functionality
- Misrepresent your identity or impersonate others
- Use the Platform to provide medical advice or services to others
- Share your account credentials with third parties
- Attempt to circumvent security measures or access controls
- Commercially exploit the Platform or its content without written authorization
Violation of these prohibitions may result in immediate account termination and legal action.
Intellectual Property Rights
Platform Content
All content on the Platform—including text, graphics, logos, software, assessment tools, and design—is owned by Polana or its licensors and is protected by copyright, trademark, and other intellectual property laws.
Your Data
You retain all rights to your personal data and assessment responses. By using the Platform, you grant us a limited license to process your data solely for the purpose of providing the Service, as described in our Privacy Policy.

Mental health assessment tools used on this platform are validated screening instruments developed by clinical researchers and medical organizations:

Account Termination
Termination by You
You may delete your account at any time through the Profile page. Upon deletion, all your personal data and assessment results will be permanently deleted within 30 days (see Privacy Policy for details).
Termination by Us
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Platform. Grounds for termination include:
- Violation of Prohibited Use restrictions
- Fraudulent account activity or payment disputes
- Harassing other users or support staff
- Compromising Platform security
- Providing false information during registration
Disclaimers and Limitations of Liability
Service Provided As-Is
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- We do not guarantee the accuracy, completeness, or timeliness of assessment results or recommendations.
- We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.
Indemnification
You agree to indemnify, defend, and hold harmless Polana, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.
Governing Law and Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of Poland and the European Union, without regard to conflict of law principles.
Dispute Resolution
In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us at legal@polana.app. If informal resolution fails, disputes will be resolved through binding arbitration or the courts of Poland, as required by applicable law.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page and notify you via email or prominent notice on the Platform.
Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and delete your account.
